Violations of the American Disabilities Act for the Elderly

Points of concern:

  1. I submitted a detailed proposal to Super. Brittain. I spoke at length with DSCS White and forwarded a copy to CCPM O’Kane for review per Super. Brittain. The Super, and DSCS White were very understanding and professional. However, the priorities are re-opening a T.C. Program. Therein is the problem no one at SCI-Frackville, is taking the plight of the elderly seriously which is a violation of the law.

  1. There are no meaningful programs that have or will address the real needs of the elderly. Staff and the administration dismiss the simple things.

Examples A:
  1.  Loss of memory and motor skill’s basic functions. I forgot my ID card and/or written        pass to go to medical, eat or to go to the commissary.
  2. The comments, the disrespectful abuse and remarks are an embarrassment to society and every child that has a parent or grandparent in prison.
  3. There are several elderly prisoners who re subjected to various forms of elderly abuse by staff in every capacity. We are the punch line of corrections, by all.

Examples B:
  1. There is one elderly prisoner that is afraid to seek medical treatment. He may have cancer, but due to the lack of human kindness and basic concern, he’s willing to just die.
  2. On 1/4/2017 I watched an elderly prisoner struggling to get back from commissary in the snow—not one person offered or bothered to assist him.
  3. I personally had an encounter with c/o West, in which I went to enter control to make a formal complaint to Captain Downs; my complaints fell upon deaf ears.
  4. There are issues of wrong medication given to the elderly and when there is a question, we’re dismissed.
  5. So my question is if the federal government allocates money for T.C, programs, because I’m certain there’s a budget for the elderly across the country?

Violations and/or Inhumane Treatment of the Elderly:

  1. See Attachment addressed to Super. Brittain
  2. Is it cruel and unusual punishment for the elderly to be abused and mistreated by correctional staff who are our primary caretakers?
  3. We’ve several elderly prisoners more than enough to bring a class action on our abuses at SCI-Frackville.
  4. Medical and care is an important part of reasonable care, custody and control under the color of law.
  5. Every afforded attempt should be given to the elderly that now are sentenced to death, twice if serving life without parole.
  6. Discrimination towards the elderly inside corrections is a reality as in society
List of real concerns and complaints:

  1. No overall training options for dealing with the elderly.
  2. Proper medical care opposed to dismissing our concerns and needs.
  3. Stop forcing the elderly to shower and go to pill-line in the freezing cold and under hazardous weather conditions.
  4. Stop forcing the elderly to stand waiting outside for commissary, visits, etc.
  5. Provide extra blankets, long johns and gloves for the elderly.
  6. Provide escorts for all elderly travelling throughout the institution.
  7. Stop all bullying and harassment of the elderly as a result of memory loss when we forget to do something.
  8. Stop forcing the elderly to stand for count, instead just require us to have our lights on.
  9. Make sure the elderly have access to the phone, activities and events.
  10. Create meaningful programs for the elderly to maintain reasonable health.
  11. Require all staff to aide the elderly through meaningful training.
  12. Fix the PA system because as it currently stands the elderly cannot hear or understand any of the announcements.
  13. Stop forcing the elderly to make outside hospital trips without coats and hats.
  14. Allow the elderly to sit-down during shakedowns.
  15. Provide extra health care for the grooming of the elderly–cutting finger and toenails, ear care, etc.
  16. Stop forcing all elderly to stand in line for main line.
  17. Provide assistance to the elderly for cell cleaning, the packing and moving of their property from one house location to another. Overall general assistance.
  18. Allow the escort assisting the elderly to sit in on medical interviews and all other procedures involving the elderly.
In closing, I thank you in advance for your time, patience and careful consideration regarding the above mentioned elderly issues here at SCI-Frackville. I look forward to hearing from you in the near future.
